Privacy notice

At Neural Earth Inc and its subsidiaries and affiliates (jointly, the "Company," "we," or "our"), accessible from https://neuralearth.ai, other affiliated websites, or through its mobile applications (collectively, the "Platform"), one of our main priorities is the privacy of our visitors. This privacy notice contains types of information that are collected and recorded by Neural and how we use that information. This privacy notice is applicable to any activities a visitor engages in while on the Platform.

We may collect the following Personal Information from you:

  • Your name;
  • A copy of or information from your government-issued identification document;
  • Your address;
  • Your business's name, address, website and phone number;
  • Your phone number;
  • Your email address;
  • Your date of birth;
  • Your Social Security or tax identification number;
  • Your IP address and geolocation;
  • Your financial transaction history (including your bank account information); and
  • Any other Personal Information you provide to us or which we believe is necessary to maintain a customer account or provide a full experience of the Platform.

Except as set forth in this privacy notice, Personal Information that you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your Personal Information or otherwise consent to our collection of it. We will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

We also collect Personal Information from a variety of sources, including from third-party service providers (e.g., social media providers, payment processors, analytics providers, search engines), from our affiliates, and from publicly available sources.

The Company follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this as part of hosting services' analytics. The information collected by log files include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the site, tracking users' movement on the website, and gathering demographic information. Some of this information may be considered "Personal Information" under applicable law, although it does not identify you individually.

We use and disclose the Personal Information we collect in various ways, including to:

  • Provide, operate, and maintain our Platform;
  • Improve, personalize, and expand our Platform;
  • Provide functionality of our Platform to you and other users;
  • Provide recommendations for other information, products, and services to you;
  • Understand and analyze how you use our Platform;
  • Collect anonymized data to understand trends in our customer base;
  • For testing, research, analysis, and product development, including to develop and improve our Platform and create new products, services, features, and functionality;
  • Communicate with you, including for customer service, to provide you with updates and other information relating to the website or our products, and for marketing and promotional purposes;
  • At your direction and with your consent;
  • Find and prevent fraud;
  • Prevent harm to the Company, the Platform, users, and others;
  • As required for legal purposes;
  • Respond to subpoenas, warrants, or other legal processes;
  • Evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets.

Meeting these purposes may require us to disclose your Personal Information within our Company; to service providers, data aggregators, and professional advisors; to selected business partners including your employer if your employer is a customer of ours. We may disclose your Personal Information for other purposes explained at the time of collection or otherwise as set out in this privacy notice.

When we disclose Personal Information to a third party for our business purposes, we enter a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract.

In addition, your Personal Information may be collected by third parties we rely upon in order to provide our services to you. Those third parties may use such Personal Information pursuant to their own privacy policies. See "Sale and Sharing" and "Your Rights and Choices" below for more information about third parties.

State consumer privacy laws may provide their residents with additional rights regarding our use of their Personal Information. This section provides information to those persons as a supplement to the information generally provided in this privacy notice.

If you reside in California, you may have certain additional rights regarding your "Personal Information" as defined under the California Consumer Privacy Act of 2018 as amended (CCPA) or otherwise. Information we collect

In general, we collect the following "sensitive personal information": precise geolocation that may include coordinates associated with a particular parcel, building, or rooftop and may not necessarily reflect the real-time location of an individual, and government-issued identifiers, but we use this information only to provide the goods or services you request.

In the preceding twelve (12) months, the Company has disclosed the following categories of Personal Information for a business purpose: identifiers; California Customer Records personal information categories; protected classification characteristics; commercial information; internet or other similar network activity; geolocation data; sensory data; professional or employment-related information; non-public education information; and inferences drawn from other Personal Information.

In addition, California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Platform that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. California and other states may provide their state residents with rights to:

  • Confirm whether we process their Personal Information.
  • Access and delete certain Personal Information.
  • Correct inaccuracies in their Personal Information, taking into account the information's nature and processing purpose.
  • Data portability.
  • Opt-out of Personal Information processing for:
    • targeted advertising;
    • sales; or
    • profiling in furtherance of decisions that produce legal or similarly significant effects.
  • Either limit (opt-out of) or require consent to process sensitive Personal Information.

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not deny you goods or services, charge you different prices or rates, provide you a different level or quality of goods or services, or suggest that you may receive a different price, rate, or level of quality.

We do not sell your Personal Information or transfer Personal Information to third parties to use for their own benefit; however, we allow certain of our third-party service providers to place tracking technologies like cookies and tags on our Platform. Those companies receive information about your interaction with our Platform that is associated with your browser or device and may use that data to serve you relevant ads on websites or services where they perform such activities. Except for this kind of disclosure, we do not "sell" any of your information within the meaning of applicable law.

The data we disclose to or receive from third party service providers may be subject to the privacy policies of those parties as well as to ours. You may have a direct contractual relationship with some of our third-party service providers (such as Google), as detailed above. Additionally, the services provided to us by such third-party service providers may entail collection and processing of Personal Information by them that is broader than the Personal Information they provide to us. This means that sometimes these third-party service providers have access to more of your Personal Information than we do. To the extent you have a direct contractual relationship with any of our third-party service providers, that contractual relationship governs any rights you may have regarding the information about you collected by such third party.

You have the option of disabling or refusing cookies at any time in your browser preferences. For mobile devices, you can manage how your device and browser share certain device data by adjusting the privacy and security settings on your mobile device. However, note that some parts of our Platform will not function properly or may be considerably slower if you refuse cookies. For example, without cookies, you will not be able to set personalized preferences, and/or may have difficulty completing transactions.

In order to respond to customer inquiries, we retain transactional data for as long as you maintain an account with us. We retain other Personal Information for as long as is necessary for the processing purpose(s) for which the information was collected, and any other permissible, related purpose. When we no longer need the Personal Information we collect, we either anonymize the information upon your request or securely destroy the information, unless we are legally required to retain it.

We are a United States business and the Platform is operated in the United States. Your Personal Information will be stored and processed on servers in the United States and other countries, and those countries may not provide the same level of data protection as the laws in your country. We will treat your Personal Information in accordance with applicable law and this privacy notice.

We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will post the updated notice on the Platform and update the notice's effective date. Your continued use of our Platform following the posting of changes constitutes your acceptance of such changes.
